Charge dropped against SC woman for not returning VHS tape

A charge against a woman in Pickens County - arrested for failing to return a VHS video rented more than eight years ago - has been dropped.

The Pickens County Magistrate's Office reports the charge against Kayla M. Finley was dropped Thursday. She was arrested February 13 on a warrant claiming she didn't return a video of the movie Monster In-Law to Dalton Video in 2005.

Finley was arrested when she visited the Pickens County Sheriff's Office on an unrelated domestic dispute last Thursday. Deputies then discovered she had an outstanding arrest warrant issued by a judge in September of 2005.

Finley was held until Friday morning when she appeared before a judge and was released on a $2,000 personal recognizance bond.

The story of the arrest received national media attention.

The Pickens County Sheriff's Office didn't investigate the case nine years ago and didn't file a charge against Finley. The sheriff's office points out authorities there have no authority or discretion to decide whether to serve or not serve a warrant.

There is also no expiration date or statute of limitations on criminal arrest warrants.

Fox Carolina News reported just after the arrested that a woman who identified herself as Finley, took to the stations Facebook page to defend herself. She claims she had to move out of state because of her husband's job and she simply forgot about it.

Plenty of comments went back and forth on social media apparently.  Some folks thought law enforcement was a little harsh.

One post reportedly said, "Wait till they find out that she forgot to REWIND the tape".

The Pickens County Sheriff's Office  said when she walked into the sheriff's office and discovered the outstanding warrant, they had no choice.
